Job Summary

The Senior Manager is responsible for the regional US Import and Export Trade Compliance program development, strategy and operational activities ensuring: 1) that all US import/export operational transactions are completed within applicable government rules and regulations; and 2) product regulatory compliance is adhered to with the various governing regulatory agencies.

US Import and Export Trade Compliance is the process by which goods enter/exit the US in conformance with all various laws and regulations. The role provides support to Supply Chain activities for nine NAM Marketing Unit and NAM Production Unit locations across two divisions including Fresenius Kabi (Pharma) and Fenwal (Med Tech) Importer of Records (IORs) and Exporter of Records (EORs).

The position also has responsibility as the local US region liaison with the Global Trade Compliance Team in Germany and ensures compliance to global trade processes and procedures.

Responsibilities

  • Establish the vision and strategy milestone plans, developing a holistic Trade Compliance program meeting all various US Agency regulation and reporting requirements controlling the import and export of goods.

  • Responsible for compliance with complex US Customs, FDA, USDA, DEA, EPA, Department of Commerce and Treasury, etc. US regulatory agency import and export regulations, permitting and reporting.

  • Create and maintain formal control procedures and training.

  • Build, develop, train, coach and mentor six direct reports.

  • Establish and build relationships with various US Agency regulator Officers and Investigators, prompt review, response, mitigation and corrective actions for various US Agency inquiries.

  • Leverage deep Global Trade subject matter expertise to advise local/regional Global Trade personnel on Trade and Customs matters.

  • Project management meeting company, program and regulatory changes.

  • Collaborate and support internal business partners Supply Chain, Legal Counsel, Risk, Compliance, Regulatory Affairs, Demand Planning, Third Party Management, Procurement, Customer Service, Accounts Payable and Receivable, etc. departments.

  • Owns and manages the relationships with external partners that provide import brokerage and export agent services on behalf of Fresenius Kabi.

  • Monitor and assess impact of changes to Global Customs and related laws and regulations and collaborate with Supply Chain leadership to take necessary action to comply and/or mitigate impact.

  • Provide direction to regional contact shipment coordinators in continuous improvement of trade compliance procedures and work instructions to ensure compliance.

  • Investigate, analyze, evaluate and implement strategic cost savings initiatives via Trade mechanisms such as foreign trade zones, duty drawback, free trade agreements, duty suspension regimes, etcetera.

  • Develop local/regional Trade Master Data Management and Compliance Screening Standards (HTS, COO, ECCN, PGAs, DPL etc.) for imports and exports.

  • Leverage internal and external data sources to develop cost and value tracking metrics (duty/fees & cost avoidances).

  • Establish standard Global Trade KPIs, metrics and report templates.

  • Employ lean/six sigma principles to prioritize continuous improvement across all Global Trade activities.

  • Manage and implement Global Customs Competency Center (CCC) directives and activities for the region.

  • Support Fresenius Kabi (US) Marketing Unit & Production Unit Supply Chain activities.

  • Develop, implement, and maintain Supply Chain Security Program (C-TPAT) with US Customs

  • Life cycle management of systems supporting import and export transactions and legal requirements (design, develop, test and implement) including SAP Global Trade System GTS and conversions from ECC to S/4Hana).

  • Other duties as assigned.

  • All employees are responsible for ensuring the compliance to company documents, programs and activities related to the Health, Safety, Environment, Energy, and Quality Management Systems, as per your roles and responsibilities.

Requirements:

  • Bachelor’s degree

  • 8+ years of Trade Compliance experience required.

  • Licensed Customs Broker strongly preferred.

  • Ability to operate independently and interact with direct reports, Supply Chain personnel, Global Manufacturing, Purchasing and Supplier Management, Marketing, Finance, Tax, outside service providers, and government officials.

  • Must have the ability to prioritize multiple projects/workflows and manage time efficiently to meet established timelines.

  • Strong problem solving, detail orientation, and analytical skills are required.

  • International trade compliance experience with a good understanding of core trade principles such as product valuation, tariff classification, C-TPAT and trade programs.

  • Thorough understanding of supply chain logistics including air, ocean, truck & rail, as well as knowledge and experience with warehousing, distribution, supplier, and inventory management.

  • Strong problem solving, detail orientation, and analytical skills are required.

  • Excellent analytical and organization skills including ability to collect, structure, analyze and communicate data.

  • Excellent written and verbal communication skills.
