Benthic is looking to add a highly diligent and meticulous Trade Compliance Manager to the team. The U.S. Trade Compliance Manager ("USCM"), reports to the Legal and Compliance Senior Director, and oversees all trade compliance activities for Acteon's Data and Robotics division ("D&R") in the USA. The USCM will liaise with the Acteon Group Compliance team to ensure robust trade compliance policies and procedures are in place, and provide technical guidance and thought leadership in all areas of trade compliance.



The successful candidate will be based in the Houston area.



Duties

  • Maintain a working knowledge of all applicable U.S. export and import regulations
  • Knowledge of current and pending compliance regulation initiatives and legislation that may affect company business
  • Maintain contacts with government regulators (e.g. DDTC, BIS), as appropriate, subject to coordination with the Acteon Group Compliance team
  • Work with the U.S. D&R sites management teams to provide guidance on current and future trade regulatory requirements as they relate to the sites business plans and future products
  • Supervise, monitor, and audit trade compliance at U.S. D&R sites, providing day-to-day trade compliance support for export and import activities
  • Support division in various business initiatives such as product transfer
  • Ensure that all applicable products held by the U.S. D&R companies are classified for export and import in accordance with regulations of the U.S., European Union, United Kingdom, and Singapore
  • Assist U.S. D&R companies as needed in the preparation and filing of export and reexport licenses or authorization applications and other submissions to applicable government agencies
  • Use Acteon Group web-based tools for the U.S. D&R sites trade compliance activities, as appropriate
  • Produce, review, analyze, and publish trade compliance process metrics for applicable sites
  • Develop an annual action plan, consistent with the U.S. D&R annual action plans, specifying the objectives of the trade compliance function for the sites
  • Ensure that procedures related to trade regulations and reporting requirements are in place for all appropriate areas of responsibility and personnel at the sites
  • Maintain a trade compliance training program at the sites
  • Ensure registrations with government agencies are kept up to date as required by regulations
  • Support the determination of license requirements and license exceptions or exemptions, as appropriate, for all transactions referred to the USCM
  • For transactions referred to the USCM or the Acteon Compliance team, release export compliance-related holds on shipments after all trade compliance requirements are satisfied
  • Assist in monitoring, supporting, and enforcing the screening of all business partners by U.S. D&R companies, adhering to Acteon Group statements regarding sanctions process to ensure export transaction screening of all end users and intermediaries
  • Adapt Acteon Group trade compliance assessment guidelines and audit checklists to site requirements to ensure adherence to Acteon Group compliance policies and procedures
  • Arrange, manage, and participate in site internal audits for U.S. D&R companies
  • Ensure access to current regulatory and compliance information for all site employees with export and import process involvement
  • Undertake root cause analysis of trade compliance breaches to understand why they happened. Use this knowledge to develop associated mitigating actions to prevent further breaches elsewhere and to strengthen the training program
  • Play an active part in Acteon Group compliance forum meetings, and work together with other Acteon divisions to drive the compliance agenda forward



Required

  • Bachelor's degree, preferred
  • 5 years' experience in import/export compliance, preferred
  • Experience of working in an organization with global Export/Import responsibility
  • Demonstrable understanding and experience of the U.S., and E.U. export control environments including ITAR
  • Previous experience in roles with responsibility for development and implementation of workplace compliance programs
  • Demonstrable track record of delivering a step change in compliance culture and behaviors within an organization that operates in a high-risk environment
