Provide Import and Export compliance oversight/guidance to BMS North America region and other regions, as required, to develop/promote/support Global Trade Compliance strategies, optimize duties and fees and expedite product movement. Support compliance with pertinent laws, regulations and guidelines mandated by government agencies (i.e., Customs, Regulatory, Bureau of Industry and Security, Census Bureau, Compliance Agencies around the world etc.) globally where BMS conducts business and work with the NA sites and Regional Compliance Leads to establish regional/country/site processes, procedures and training to support these requirements. Provide primary back-up to Sr. Director, Global Customs & Trade.
RESPONSIBILITIES
- Actively participate in development of strategic direction for global customs & trade compliance. Manage and provide leadership for customs compliance in NA. Support other regions as required.
- Provide guidance to North America Sites and Regional Compliance Leads to optimize performance of Global Trade Compliance activities and actively participate in the development of processes, procedures/directives/policies for managing Customs compliance globally.
- Ensure the establishment of Import and Export Administration teams in North America to manage global trade compliance. Align with AD, Export Compliance on strategic direction for Export Compliance mgmt ensuring a fully integrated compliant approach.
- Develop and/or deliver training as needed for BMS colleagues to raise awareness to changing regulations or to meet requirements of global trade programs we are members of.
- Evaluate and implement opportunities for optimizing duty savings associated with Customs imports by conducting duty analyses and use of duty minimization programs (i.e., Foreign/Free Trade Zones, Free Trade Agreements, Inward Processing, Processing Under Customs Control and other Duty Reduction Regimes.)
- Provide support and analyses for Government Agency Partnership Programs (i.e., ISA, C-TPAT, AEO, FDASSCP), to respond to enquiries and also to maintain membership of global trade programs we are members of.
- Work with Regional Compliance Leads to develop and implement self assessment programs globally in line with best practices and global trade program requirements.
- Provide assistance in preparation for Import /Export and other Customs Compliance related audits and actively participate in audits providing guidance and support to BMS site or function involved in audit.
- Work with Sites/Regional Compliance Leads to determine business changes required to address new US driven regulations or changes to regulations. If appropriate provide guidance to regional global trade leads on new or amended in region regulations.
- Insure the management of Customs Brokers in N America
- Perform /Facilitate the assignment of Customs tariff classification to products/commodities in N America providing major category classification codes to the other Regional Global Trade Leads.
- Facilitate the clearance of goods through government agencies at North America borders and other regions via Regional Compliance Leads
- Serve as core member to the Global Trade Compliance Virtual Center of Excellence. May or may not have direct reports.
- Provide support to evaluate and drive the implementation of a Global Trade Compliance System.
- Work with Tax, Legal, Finance, Procurement, TPM’s, Plant Sites, R&D/CSO, Logistics, Regulatory, Corporate Security, External partners and others to align and implement Global Trade strategies and processes for BMS.
- Provide primary back-up to Director, Global Customs & Trade.
COMPETENCIES
- Extensive knowledge and experience of Customs regulations, classification, valuation, country of origin, incoterm determination and translation into business practices, processes.
- Extensive knowledge of Foreign/Free Trade Zone, Free Trade Agreement, Inward Processing, Processing Under Customs Control and other Duty Minimization Regimes management principles.
- Extensive knowledge of FDA or other Ministry of Health regulations as they apply to imports.
- Knowledge of Export Controls, Sanctions, Anti-boycott and Restricted Party Screening regulations.
- Understanding of global biologics manufacturing, logistics and distribution operations desirable.
- Experience in developing and implementing Global Trade Compliance process, principles and practices.
- Experience with AEO, C-TPAT and other relevant Supply Chain Security Programs preferred
- Experience with Importer Self Assessment and similar programs preferred
- Extensive experience interacting with Commercial and R&D functions.
- Demonstrated ability to deliver against challenging goals and objectives in a complex, ambiguous and highly regulated environment.
- Demonstrated leadership capabilities in building highly effective, world class, global cross-functional teams
- Demonstrated project management and team building skills.
- Demonstrated ability to analyze and interpret complex problems/data gathered from a variety of sources and, through effective decision-making and planning, and deliver superior business solutions.
- Demonstrated ability to lead a diverse team in a high performance culture and complex changing environment to deliver results which contribute to BMS’ performance, sustainability and growth.
- Demonstrated ability to negotiate with, influence, collaborate and communicate directly and to lead cross functional and cross regional teams in complex, high impact, highly–regulated situations.
- Required: Strong computer skills. Experienced in Excel, Word, PowerPoint, and SAP.
- Preferred: Strong strategic, conceptual and analytical thinking, problem solving and rapid decision making skills.
QUALIFICATIONS
- Bachelors degree in relevant area, MBA degree a plus. Licensed Customs Broker preferred
- 10 years experience in Global Trade function required with a BioPharma or similar company preferred.
